1. Account Registration and Security

You must be at least 13 years old to use our Service. If you are under 18, you must have parental or guardian consent. You are responsible for maintaining the confidentiality of your login credentials and for all activities that occur under your account. You agree to notify us immediately of any unauthorized access to your account.

2. Intellectual Property and License

Bling AI retains exclusive ownership of the app's code, design, graphics, branding, and all proprietary features. We grant you a limited, non-exclusive, non-transferable, and revocable license to access and use the Service for your personal or commercial use in accordance with these Terms. You may not reverse engineer, copy, modify, distribute, or create derivative works of the Service without our prior written permission.

3. AI-Generated Content Disclaimer

Bling AI uses artificial intelligence to generate images and videos based on your inputs. Please be aware of the following:

• AI-generated outputs are provided "as is" and may contain artifacts, inaccuracies, or unexpected results.
• You are solely responsible for reviewing all generated content before using it in any marketing campaign, publication, or commercial context.
• Bling AI does not guarantee that generated images will be free from errors, biases, or unintended content.
• You retain commercial usage rights to the images and videos generated through your use of the Service, subject to these Terms.
• Bling AI does not claim ownership of your generated outputs. However, we may use anonymized and aggregated data to improve our AI models and Service.

4. User Content

By uploading jewelry images or other content to our Service, you grant Bling AI a non-exclusive, worldwide, royalty-free license to process, store, and use such content solely for the purpose of providing and improving the Service. You represent and warrant that:

• You own or have the necessary rights to upload the content.
• Your content does not infringe on the intellectual property rights of any third party.
• Your content does not contain illegal, harmful, or objectionable material.

5. Subscriptions and Payments

Bling AI offers subscription plans that provide access to additional features and credits. Subscriptions are billed through the Apple App Store or Google Play Store. All billing, payment processing, and refunds are handled by the respective app store. Subscriptions automatically renew unless cancelled at least 24 hours before the end of the current billing period. You can manage your subscription through your app store account settings.

6. Prohibited Activities

You agree not to:

• Use the Service for any unlawful purpose.
• Attempt to interfere with or disrupt the Service or its infrastructure.
• Upload malicious code, viruses, or harmful content.
• Scrape, data mine, or use automated tools to access the Service.
• Impersonate any person or entity, or misrepresent your affiliation.
• Use the Service to generate content that infringes on others' intellectual property rights.
• Resell or redistribute the Service or generated content in bulk without authorization.

7. Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE, OR THAT AI-GENERATED CONTENT WILL MEET YOUR EXPECTATIONS.

8. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, BLING AI AND ITS AFFILIATES SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, OR USE, ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF THE SERVICE OR AI-GENERATED CONTENT. OUR TOTAL LIABILITY SHALL NOT EXCEED THE GREATER OF $50 USD OR THE AMOUNTS YOU HAVE PAID TO US IN THE SIX MONTHS PRECEDING THE CLAIM.

9. Indemnification

You agree to indemnify and hold harmless Bling AI, its officers, directors, employees, and agents from any claims, damages, losses, or expenses (including reasonable attorney's fees) arising out of your use of the Service, your violation of these Terms, or your infringement of any third party's rights.

10. Governing Law and Dispute Resolution

These Terms shall be governed by and construed in accordance with the laws of the State of Delaware, United States, without regard to its conflict of law provisions. Any disputes arising under these Terms shall be resolved through binding arbitration in accordance with the rules of the American Arbitration Association, except where prohibited by law.

11. Changes to These Terms

We reserve the right to modify these Terms at any time. Changes will be posted on this page with an updated "Last Updated" date. Your continued use of the Service after changes constitutes acceptance of the modified Terms.
